Introduction

This Terms and Conditions document is an electronic record under the Information Technology Act, 2000 and applicable rules. By accessing or using the OTAPrime Holidays LLP website (https://otaprime.com) or related channels (the “Platform”), you agree to be bound by these Terms and all policies referenced here. “OTA Prime” or “we” refers to OTAPrime Holidays LLP, registered office: F2, Gorakhnath Complex, Boring Road, Patna, Bihar, India. “You” or “user” refers to anyone who accesses or uses this Platform.

Eligibility and Account

• Provide accurate, current details when registering or transacting; keep your credentials confidential and notify us of any unauthorized use.
• OTAPrime Holidays LLP is not liable for losses from unauthorized account use.

Personal and Non-Commercial Use

Services are offered for personal, non-commercial bookings for yourself or those you are authorized to represent. Commercial resale requires prior written permission from OTAPrime Holidays LLP. We may cancel bookings that violate this.

Scope of Services

OTAPrime Holidays LLP acts as an intermediary between you and independent suppliers (airlines, hotels, tour operators, visa agencies, event organizers, transport providers, etc.). Your contract for services is with the supplier. We arrange/facilitate bookings and share supplier confirmations (e.g., PNR, voucher). Service descriptions and pricing originate from suppliers and may change without notice.

No Warranty for Suppliers

We do not guarantee the quality, suitability, safety, or availability of supplier services. Issues such as delays, baggage loss, injuries, service lapses, or visa outcomes are the responsibility of the respective supplier/authority. We may assist with escalation but assume no liability for third-party actions or omissions.

User Obligations

• Abide by supplier rules (airline carriage, hotel policies, tour rules, etc.).
• Carry valid passports, visas (including transit), permits and health documents; any visa decision rests with the consulate/embassy.
• Provide accurate traveller details; correction fees may apply where allowed.
• Use the Platform lawfully; no speculative, false, or fraudulent bookings.
• If booking for others, you confirm their consent to share data and that they accept applicable terms.

Booking and Payment (INR only)

• Prices are dynamic until confirmed. Bookings confirm only after payment receipt and supplier issuance of confirmation.
• Payments must be in Indian Rupees via domestic payment instruments. Any currency display is indicative; charges occur in INR.
• Taxes, surcharges, convenience and service fees may apply and are generally non-refundable unless required by law.
• If a transaction fails after payment capture, our liability is limited to refunding the amount received for that failed booking.
• Bookings remain subject to later-imposed or revised taxes/levies; you agree to pay such statutory amounts when applicable.

Cancellations and Refunds

Supplier rules govern changes/cancellations and any associated fees or eligibility. See our Refund Policy for detailed timelines and processes. No-shows are typically non-refundable. Supplier-initiated cancellations are handled per supplier policy.

Use of Platform Content

All Platform content is protected by intellectual property laws. You may make personal, non-commercial use only. Do not copy, resell, or exploit content without written consent.

External links are provided for convenience. We neither control nor endorse third-party sites and assume no responsibility for their content, policies, or availability.

Prohibited Activities

You agree not to disrupt the Platform; bypass security; scrape without permission; impersonate others; post unlawful/abusive content; distribute malware; or overload our infrastructure.

Disclaimers

The Platform and services are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including merchantability, fitness, or non-infringement. We do not warrant uninterrupted or error-free operation.

Limitation of Liability

To the maximum extent permitted by law, OTAPrime Holidays LLP is not liable for indirect, incidental, special, or consequential damages. Our aggregate liability shall not exceed the OTAPrime Holidays LLP service fees (if any) you paid for the impacted booking.

Indemnification

You agree to indemnify and hold harmless OTAPrime Holidays LLP, its affiliates, officers, and employees from claims arising out of your use of the Platform, breach of these Terms, violation of law, or infringement of third-party rights.

Force Majeure

We are not liable for delays or failures caused by events beyond reasonable control (e.g., acts of God, strikes, epidemics, regulations, outages). Obligations are suspended during such events and reasonable assistance will be provided where possible.

Modification of Terms

We may update these Terms at any time by posting a revised version with an updated date. Continued use constitutes acceptance of the changes.

Governing Law and Jurisdiction

These Terms are governed by the laws of India. Courts in Patna, Bihar shall have exclusive jurisdiction for disputes arising hereunder.
